Who is the producer in Spain?

The obligations follow whoever first places packaged goods on the Spanish market. Eight situations, and who carries the duty in each.

Quick answer

The producer is whoever first places the packaged product on the Spanish market. If you ship to Spanish consumers or end users, that is you. If a Spanish business buys on its own account and resells, that business is the producer for those goods. Marketplaces become the producer where a foreign seller has appointed no representative.

The rule

Spanish packaging law attaches the obligations to whoever first makes the packaged product available on the Spanish market. Everything below follows from that single sentence.

The distinction that decides most cases

Whether your Spanish business customer resells the goods or uses them. A reseller starts a new step in the Spanish supply chain and takes the producer role for what it places on the market. A business that consumes the goods is an end user, exactly like a consumer, and you remain the producer.

Same pallet, same invoice, opposite answers. It is worth settling in writing with the customer rather than assuming.

Household or commercial packaging

A second question follows, and it changes which scheme you join rather than whether you are the producer. Packaging that typically ends up with a private consumer is household packaging and goes to Ecoembes, or Ecovidrio for glass. Packaging that reaches only businesses is commercial or industrial and goes to Envalora or another industrial scheme, at markedly lower rates. A company doing both needs both.
